Résumé

Les Académies nationales de médecine et de pharmacie rappellent leurs Recommandations conjointes du 20 octobre 2014: en matière de prescription médicamenteuse, le respect du libellé de l’Autorisation de mise sur le marché (AMM), tel que formulé dans le Résumé des Caractéristiques des Produits doit être la règle. Il existe toutefois deux grands types de prescriptions de médicaments hors AMM à bien distinguer: celles qui, injustifiables, nécessitent la poursuite et le renforcement des mesures en vigueur et celles qui, en revanche,  sont indispensables à une bonne prise en charge de certains patients (en particulier enfants, personnes âgées, femmes enceintes…): justifiables, elles devraient être reconnues comme telles, ce qui n’est pas toujours le cas, et bénéficier d’un statut approprié. Il importe en effet de prendre en considération un certain nombre de circonstances où le strict respect de l’AMM ne coïncide pas avec la meilleure prise en charge thérapeutique du patient, c’est-à-dire avec l’obligation déontologique et légale de lui procurer les meilleurs soins. Hormis le cas des prescriptions en milieu hospitalier où le prescripteur peut se référer à  d’éventuelles recommandations des Comités du médicament, il appartient en général au praticien de justifier par lui-même, au cas par cas la prescription hors AMM qu’il juge indispensable à l’état de son patient. C’est lui demander de faire une veille de la littérature et lui donner beaucoup de responsabilités. C’est pourquoi les recommandations présentées dans ce rapport ont été guidées par les trois idées-forces suivantes: a) comment optimiser, en la rationalisant, la prise en charge médicamenteuse de certains patients en situation très préoccupante d’impasse thérapeutique, b) comment aider le professionnel de santé, souvent isolé et désemparé dans ce type de situation, à prendre la décision la plus appropriée parce que la plus rationnelle au vu de la réglementation et des données validées de la littérature et c) comment favoriser la prise en charge justifiée de ces situations par l’Assurance maladie dans le cadre de la règle générale.

Summary

Prescribing within scope of Market Authorization (MA) label should remain the rule. However the National health authorities should adopt a discriminatory attitude according to the different situations. There are indeed two types of drug prescriptions to be distinguished in the field of Off-label drug use: the prescriptions that cannot be justified, requiring the pursuit and reinforcement of the existing constraining measures and, on the other side, the prescriptions indispensable to the best management of certain types of patients (particularly children, elderly people, pregnant women…), which are justifiable and should be recognized as such (which is not currently often the case) and also benefit of an appropriate status. As a matter of fact it is important to take into account a number of circumstances when the strict compliance of the MA labelling does not coincide with the appropriate management of the patient and therefore the deontological and legal obligation to give him the best care. The recommendations presented in this report have been led by three following key-points:
a) How to optimize and rationalize the medical management of patients in the very worrying situation of being at the end of the therapeutic options b) How to help the practitioner to make a good and rational decision in the light of validated data  and c) How to enable the reimbursement, within the general rule, by the National Health Insurance of justified Off-label drug use.
The National health authorities should first give themselves the means to identify the unjustified Off-label prescriptions. The pharmaceutical industry should be strongly encouraged by the health authorities to ask for a MA or an extension of the MA indication when strong data on recommended medicine are already available or in case of well-established medical use. Prescribers and pharmacists should regularly be sensitized and trained to problems the prescriptions and the dispensing of Off-label drugs present, including economical and forensic consequences. Prescribers and pharmacists should regularly be given update and evidence summaries on medicines in addition to the information represented by the MA label. In this regard, a Standing Committee of Experts could be created in order to synthetize evidence regarding Off-label use and to disseminate its reports. That Committee would accept some Off-label uses, allowing a better adequacy between practices and updated data acquired from the science. Its points of view would be founded on the need for medical care in the concerned diseases and so particularly when there is no authorized alternative drug or when a non-authorized drug has proven on available scientific data its superiority confronting to authorized previous ones. The Off-label prescriptions considered as relevant by this Committee should be subject to data collection, specific control and reimbursed by the National Health Insurance.
